Terms of Service

1. Validity, provider, offer, conclusion of contract, retention of title
For offers and sales, deliveries or provision of services from the provider "Service around the computer" or the gameshop: "Celestial-Gameshop.de, represented by the owner Mr. Marcel Mamok, Eckstr 1, 66440 Blieskastel, email: celestialgameshop@gmail.com (hereinafter: celestial-gameshop.de) for goods from the website www.celestial-gameshop.de or via the sales platforms Cardmarket or eBay, these conditions apply exclusively. celestial-gameshop.de does not recognize any deviating conditions, even if an objection is not expressly made. Acknowledgment is only made through an express written confirmation of their validity by celestial-gameshop.de. Agreements deviating from these conditions should be set out in writing for purposes of evidence.

2. The subject of the respective contract is the sale of goods / services by celestial-gameshop.de to the respective buyer via the website www.celestial-gameshop.de or the sales platforms Cardmarket or eBay. These are video games, consoles, trading cards, and merchandise and electronics accessories. These trading cards are offered in both used and new condition. These goods are offered by celestial-gameshop.de either on the aforementioned homepage or the sales page on Cardmarket and eBay as shop items or on eBay as general auction items. General auction items are visible on both the general eBay websites and in the seller's eBay shop. The goods offered on the general eBay websites or in the seller's eBay shop are binding offers by the seller to conclude a purchase contract for the respective item.

3. When placing an order in the online shop at www.celestial-gameshop.de, clicking the "Submit order" button represents an offer to celestial-gameshop.de to conclude a purchase contract. You will receive an email immediately after receiving your order , in which the receipt of your offer is confirmed without this already representing the acceptance of the offer. The acceptance of your offer (and thus the conclusion of the contract) by celestial-gameshop.de takes place through a declaration of acceptance by e-mail or post or by agreeing a Delivery date for the purchased item in the corresponding video game or an order or order confirmation from celestial-gameshop.de.

4. All goods remain the property of celestial-gameshop.de until full payment of the purchase price and all claims associated with the purchase. All mentioned brand names and registered trademarks or third party property content used only serve to describe the performance of celestial-gameshop.de. By purchasing the service from celestial-gameshop.de via the homepage or eBay, the buyer agrees that no ownership, intellectual property or other rights to the virtual objects described here are transferred to him.

5. When ordering via our online shop, the ordering process comprises a total of five steps. The first step is to select the goods you want. In the second step you confirm the selection of goods. In the third step, enter your customer details including the billing address and choose how you would like to pay. You can also skip this step by being forwarded directly to the checkout via PayPal Express. In the fourth step, the order is completed, whereby the payment option PayPal is forwarded to PayPal, where the payment instruction is then confirmed; if the payment option transfer is selected, the account details are displayed to which the customer then has to instruct the payment. By clicking on 'Check order', in the fifth step, all the data will be displayed again for checking and the order will then be forwarded to us. By leaving this page, you can cancel the ordering process.

6. We do not save the contract text of your order. You can print out the text before sending your order to us by clicking on "Print" in the last step of the order in the browser. We will also send you an order confirmation with all order data to the email address you provided.

7. You also have the option of adding personal notes to the order before completing an order. This is useful, for example, if you want to inform us about the dates for a collection, several purchased items should be sent separately or the order should be sent to a different address.




Return cost agreement, cancellation policy

If you make use of your right of withdrawal, we will only bear the regular costs of the return if such is necessary, if the goods arrive undamaged and salable. In any case, you have to pay in advance for return costs. We take the goods back without a revocation according to paragraph 1ff. or there is a warranty claim, you have to bear any shipping costs yourself without reimbursement.

Right of withdrawal


1. You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods. In order to exercise your right of withdrawal, you have to contact us company "Service around the Computer", represented by the owner Marcel Mamok, Eckstr. 1, 66440 Blieskastel, email: celestialgameshop@gmail.com by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of the withdrawal



2. If you withdraw from this contract (e.g. cancellation of an order), we will give you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you use a different type of delivery than that of have chosen the cheapest standard delivery offered to us), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
- Any PayPal or transaction fees for orders cannot be refunded in some cases!
- You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
- We only bear the costs of returning the goods if you return the goods to us intact, in their original packaging and salable within the return period. To do this, you have to pay in advance for the return costs. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
- If you have requested that the services should begin during the cancellation period, you have to pay us a reasonable amount that corresponds to the portion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract Compared to the total scope of the service provided in the contract.
- Note on the provisional expiry of the right of withdrawal - in the case of a contract for the provision of services, your right of withdrawal expires prematurely if we have provided the service in full and have only started performing the service after you have given your express consent and at the same time confirmed your knowledge of it that you lose your right of withdrawal if we have fully fulfilled the contract.

Exceptions to the right of withdrawal


Unless otherwise specified, the right of withdrawal does not apply to distance contracts


- for the delivery of goods that are not prefabricated and for the production of which an individual selection or order by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
- for the delivery of goods that can spoil quickly or whose use-by date would be exceeded quickly,
- for the delivery of sealed goods that are not for reasons of health protection or hygiene
- are suitable for return if their seal has been removed after delivery,
- for the delivery of goods if they were inseparably mixed with other goods after delivery due to their nature, for the delivery of audio or video recordings or computer software in a sealed package, if the seal was removed after delivery,
- for the delivery of newspapers, magazines or magazines with the exception of subscription contracts.

Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, vehicle rental, delivery of food and beverages and the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for the provision.

3. Shipping costs, delivery, discounts


Our products are delivered by DHL or the German Post. The shipment is expressly insured or with a tracking number for better traceability. If uninsured shipping is desired (please make a note in the note field before completing the order), the buyer bears sole liability and must request a corresponding tracking of the loss of the order from the post office or from DHL. All shipping costs and other shipping options can be found here. Any discounts cannot be combined with one another. The buyer can only claim one discount per order if one is granted. A valid discount code is regularly placed visibly in the upper area.



4. Payment modalities

Payments can be made:


- By transfer / invoice - When you place your order, you will receive an invoice from us with payment details and a description of the further procedure. You pay the bill with a normal transfer in your bank account. If we have successfully received your payment, your order will be sent and you will receive a corresponding shipping confirmation.
- or by PayPal or PayPal Express - During the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, legitimize with your access data and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You'll get more information during the ordering process.
- or by cash payment - after submitting the order for collection, you will receive an email from us regarding the possible collection times in our shop. We will make a binding appointment with you and prepare your order for collection. When picking up, you can pay in cash as well as via PayPal on site and you will receive a corresponding invoice for your documents.

5. Warranty, liability

The statutory right to liability for defects applies. Information on any additional guarantees that may apply and their precise conditions can be found with the product and on special information pages in the online shop.

celestial-gameshop.de has unlimited liability insofar as the cause of the damage is based on intent or gross negligence.

Furthermore, celestial-gameshop.de is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance you regularly trust. In this case celestial-gameshop.de is only liable for the foreseeable, contract-typical damage. Celestial-gameshop.de is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

The above limitations of liability do not apply in the case of injury to life, body and health, for a defect after assuming a guarantee for the quality of the goods and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

As far as the liability of celestial-gameshop.de is excluded or limited, this also applies to breaches of duty by the vicarious agents of celestial-gameshop.de.



6. Procurement risk, delivery delays, failure, difficulties


celestial-gameshop.de assumes no procurement risk, even if it is a purchase contract for generic goods. We are only obliged to deliver from our stock of goods and the delivery of goods ordered by us from our licensees and suppliers.

Our delivery obligation does not apply if we ourselves are not supplied correctly and on time despite a proper congruent hedging transaction and we are not responsible for the lack of availability, we have informed you of this immediately and we have not assumed a procurement risk. In these cases, any advance payments will be immediately reimbursed by celestial-gameshop.de.

The delivery time is extended appropriately in the event of circumstances impairing delivery due to force majeure. Force majeure includes strikes, lockouts, official interventions, energy and raw material shortages, transport bottlenecks through no fault of one's own, operational hindrances for example through fire, water and machine damage and all other hindrances that we were not culpably caused by an objective point of view. We will notify you immediately of the beginning and end of such obstacles. If the impediment to performance in the aforementioned cases lasts for a period of more than 4 weeks after the originally applicable delivery times, you are entitled to withdraw from the contract. Further claims, especially for damages do not exist.

In the event of delivery delays or delivery cancellations on the part of our suppliers or the manufacturers themselves, we reserve the right to cancel customer orders without giving any further reasons. Unfortunately, these situations can arise at the moment, especially with trading cards, and we apologize for the inconvenience. However, it is not in our power to prevent cancellations or to predict exact delivery quantities or times. Thank you for your understanding.




7. Industrial property rights, data protection


All logos, photographs and other images on the website or in the online catalog are protected by trademark and copyright law. Any use without the consent of celestial-gameshop.de, in particular the unauthorized download of images, is prohibited and will be prosecuted under civil or criminal law. Otherwise, reference is made to section 1ff. of these General Terms and Conditions.

All personal data are treated confidentially in accordance with the applicable data protection regulations. For more information, please refer to our data protection provisions printed on the order form.



8. Applicable Law


German law applies to the exclusion of the UN Sales Convention (CISG) insofar as this does not withdraw the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence.

Information on online dispute settlement / general information obligation according to § 36 VSBG: The EU Commission has created an internet platform for online settlement of disputes (so-called "OS platform"). The OS platform serves as a point of contact for the out-of-court settlement of disputes regarding contractual obligations arising from online sales contracts. The customer can reach the OS platform under the following link: http://ec.europa.eu/consumers/odr/. celestial-gameshop.de is neither obliged nor willing to participate in dispute settlement procedures at a consumer arbitration board.
